Terms of Service

LAVRIA (“we”, “us”, “our”) operates the website and online store at lavria.online (the “Storefront”). The Storefront is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and related services to you.

These Terms of Service (the “Terms”) apply to everyone who accesses or uses the Storefront, including browsers, customers, and contributors of content. Please read them carefully. If you do not agree to these Terms, you may not access or use the Storefront. Any new features or tools added to the Storefront will also be subject to these Terms.

You must be at least the age of majority in the jurisdiction where you live, or have the consent of a parent or legal guardian, to use the Storefront. You may not use our products or services for any unlawful or unauthorized purpose or violate any applicable law through your use of the Storefront.

Customer authentication and account management are provided through Shopify Customer Accounts. You are responsible for providing accurate account information, maintaining the confidentiality of your access credentials and verification methods, and for activity carried out through your account. Please notify us promptly if you believe your account has been used without authorization.

We make reasonable efforts to present product descriptions, photographs, colours, measurements, prices, and availability accurately. The appearance of colours and details may vary depending on your device and display settings. Product information and availability may be changed without notice.

Certain products may be available exclusively online and may have limited quantities. Purchases, returns, and refunds are subject to our Returns & Exchanges Policy. We may limit the quantities of products offered or sold where reasonably necessary, including to address availability, suspected misuse, or errors.

An order submission is an offer to purchase. We may accept, decline, limit, or cancel an order, including where a product is unavailable, information is inaccurate, payment authorization is unsuccessful, or we reasonably suspect fraud, resale, or misuse. An order is not accepted until it has been confirmed through the Shopify-powered checkout process.

You agree to provide current, complete, and accurate purchase, billing, and contact information so that your order can be processed and we can contact you when needed. If we change or cancel an order after submission, we will use the contact information supplied with the order to notify you where reasonably possible.

Storefront prices are displayed in Canadian dollars unless otherwise indicated. Prices, promotions, and product availability may change without notice. Applicable taxes, shipping charges, duties, and other charges will be shown or addressed as part of checkout where supported and applicable.

Checkout and payment processing are powered by Shopify and the payment providers made available through Shopify. LAVRIA does not store or process your full payment-card details. You authorize the applicable payment provider to charge the amounts presented at checkout, and you represent that you are authorized to use the payment method submitted.

LAVRIA currently accepts orders for delivery to Canada and the United States. Orders are prepared and processed within 2–4 business days after placement. Business days exclude weekends and applicable holidays, and processing time is separate from shipping or transit time.

Within Canada, Standard Shipping is $12 CAD, with complimentary Standard Shipping on orders of $150 CAD or more. Estimated transit time is 3–5 business days after processing. To the United States, Standard International Shipping is $18 CAD, with complimentary Standard International Shipping on orders of $200 CAD or more. Estimated transit time is 5–8 business days after processing.

Delivery estimates are not guarantees and may be affected by carrier delays, weather, customs processing, holidays, or other circumstances outside LAVRIA’s control. U.S. orders may be subject to customs, duties, taxes, or other import charges. Where those charges are not collected at checkout, the recipient is responsible for charges assessed upon import. Eligible items may be returned within 14 days after delivery, subject to our Returns & Exchanges Policy. LAVRIA does not offer direct exchanges; customers seeking another size, style, or product must return the eligible original item and place a new order.

The Storefront and its content—including the LAVRIA name and branding, text, photography, graphics, product presentation, design, and other materials—are owned by or licensed to LAVRIA and are protected by applicable intellectual-property laws. Shopify and its licensors retain all rights in the Shopify platform and related technology.

You may use the Storefront only for personal, non-commercial shopping and informational purposes. You may not copy, reproduce, distribute, modify, publish, sell, exploit, or create derivative works from Storefront content without prior written permission from the relevant rights holder.

The Storefront may provide access to optional tools or features made available by Shopify or other providers. Such tools may be provided “as is” and “as available”, without our monitoring, control, or endorsement. Your use of an optional tool is voluntary and subject to any terms provided by the relevant provider.

The Storefront may contain links to websites or services operated by third parties. We are not responsible for examining or evaluating third-party content, products, services, privacy practices, or terms. Accessing a third-party service is at your discretion, and you should review the provider’s terms and policies before completing a transaction or sharing information.

Shopify provides the ecommerce infrastructure used by the Storefront, including cart, checkout, payment, and customer-account functionality. Purchases made through the Storefront are transactions between you and LAVRIA. Shopify is not the seller of LAVRIA products and is not responsible for fulfilling orders, handling product enquiries, or administering LAVRIA’s shipping and return policies.

Your use of Shopify-hosted services may also be subject to Shopify’s own terms and privacy practices. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between you and LAVRIA, or between you and Shopify.

Our collection and use of personal information through the Storefront are described in our Privacy Policy. Because the Storefront is powered by Shopify, information submitted through the Storefront is also processed in accordance with Shopify’s applicable privacy practices.

If you send us ideas, suggestions, proposals, reviews, or other feedback, you grant LAVRIA a non-exclusive, worldwide, royalty-free right to use, reproduce, adapt, publish, and otherwise use that feedback for lawful business purposes, without an obligation of confidentiality or compensation. You represent that your feedback does not violate any third-party rights or contain unlawful or harmful material.

Information on the Storefront may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, availability, or other content. We reserve the right to correct errors, update information, or cancel affected orders where permitted by law. If an error affects an order you have placed, we will take reasonable steps to notify you using the contact information provided with the order.

You may not use the Storefront or its content:

• For any unlawful, fraudulent, abusive, or unauthorized purpose.
• To violate applicable laws, regulations, or the rights of LAVRIA or any third party.
• To infringe intellectual-property, privacy, publicity, or other rights.
• To transmit malicious code, interfere with security, or disrupt the Storefront or connected services.
• To collect or track another person’s information without lawful authority.
• To impersonate another person, submit false information, or engage in deceptive conduct.
• To scrape, crawl, copy, resell, or commercially exploit the Storefront or its content without permission.
• To circumvent access controls or interfere with Shopify-powered cart, checkout, payment, or customer-account services.

These Terms remain effective unless terminated by you or by us. You may stop using the Storefront at any time. We may suspend or terminate access where we reasonably believe you have violated these Terms, misused the Storefront, or created a security or legal risk. Obligations and liabilities incurred before termination, and provisions that by their nature should survive, will continue after termination.

To the maximum extent permitted by applicable law, the Storefront and its services are provided “as is” and “as available”. We do not warrant that access will always be uninterrupted, timely, secure, or error-free, or that every result obtained through the Storefront will be accurate or reliable. Nothing in these Terms excludes warranties, conditions, or rights that cannot lawfully be excluded or limited.

To the maximum extent permitted by applicable law, LAVRIA and its owners, personnel, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential loss arising from your use of, or inability to use, the Storefront or products purchased through it. Where liability cannot lawfully be excluded, it will be limited only to the extent permitted by law. Nothing in these Terms limits liability that applicable law does not allow us to limit.

To the extent permitted by applicable law, you agree to indemnify and hold harmless LAVRIA and its owners, personnel, affiliates, agents, contractors, service providers, and licensors from third-party claims, liabilities, damages, and reasonable costs arising from your material breach of these Terms, violation of applicable law, or infringement of another person’s rights.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the greatest extent permitted by law and severed only to the extent necessary. The remaining provisions will continue in full force and effect.

A failure by LAVRIA to exercise or enforce a right under these Terms does not waive that right. These Terms, together with the policies and notices linked or posted on the Storefront, form the entire agreement between you and LAVRIA concerning your use of the Storefront and supersede prior communications on that subject.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations as part of a reorganization, transfer of the Storefront or business, or other lawful transaction, subject to applicable law.

These Terms and any separate agreements through which LAVRIA provides products or services will be governed by and interpreted in accordance with the laws of the jurisdiction in which LAVRIA is headquartered, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Headings are included for convenience and readability only. They do not limit or otherwise affect the interpretation of these Terms.

We may update these Terms from time to time to reflect changes to the Storefront, our practices, or applicable law. The current version will be posted on this page with a revised “Last updated” date. Changes take effect when posted unless a later date is stated. Your continued use of the Storefront after an update constitutes acceptance of the revised Terms to the extent permitted by law.
